1. Agreement to Terms

By accepting a quote, estimate, invoice, or proposal from Alaska Smart Home Designs, LLC, dba: Alaska Home Renovations & Repairs (“the Company”), the client (“Customer”) agrees to the following Terms and Conditions. These terms govern all services, installations, and materials provided by the Company unless otherwise agreed to in writing.

2. Scope of Work

All work will be completed as described in the approved proposal or service agreement. Any additions, changes, or modifications to the scope of work must be requested in writing and may result in additional costs and adjusted timelines.

3. Estimates and Pricing

All estimates are valid for 30 days from the date of issue unless otherwise stated. Pricing is based on current labor and material costs and may be adjusted in the event of significant market fluctuations or supply chain changes.

Overtime Rates:
Labor performed beyond eight (8) hours in a single workday, outside of normal business hours (Monday through Friday, 9:00 AM to 5:00 PM), or on recognized holidays, as requested by the Customer in writing, will be billed at overtime rates in accordance with applicable Alaska labor laws. Overtime rates are non-negotiable and will be applied to the affected portion of work and reflected in the final invoice or approved change order.

4. Payment Terms

  • Payment Due Date: Payment is due upon completion of work unless otherwise specified in the invoice or written agreement.

  • Late Fees: A finance charge of 2% (or the maximum allowable under Alaska law, whichever is less) will be applied to any unpaid balance starting 7 days after the invoice due date and will accrue bi-weekly thereafter until the balance is paid in full.

  • Returned Payments: A $125 fee will apply to all returned, reversed, or dishonored payments.

  • Suspension of Work: The Company reserves the right to suspend or terminate ongoing work or future scheduling for accounts with overdue balances.

5. Right to Lien

In accordance with Alaska Statutes Title 34, Chapter 35 (Mechanic’s and Materialmen’s Liens), Alaska Smart Home Designs, LLC, DBA Alaska Home Renovations & Repairs, retains the legal right to file a lien against the property for any unpaid balance related to labor, materials, or services rendered.
By engaging the Company’s services, the Customer acknowledges and agrees that failure to pay in full may result in a lien being filed against the property where services were performed.

6. Change Orders

All deviations from the original scope of work must be authorized in writing by the Customer and approved by the Company. Additional charges may apply for materials, labor, and scheduling changes.
Change orders will be documented in the form of a new quote, estimate, invoice, or proposal from Alaska Smart Home Designs, LLC, DBA Alaska Home Renovations & Repairs.

7. Warranty and Liability

The Company warrants that all workmanship will be performed in a professional and workmanlike manner. Manufacturer warranties apply to all provided materials where applicable.
The Company shall not be liable for any delays, damages, or costs resulting from circumstances beyond its control, including but not limited to weather events, material shortages, or acts of third parties.

8. Customer Responsibilities

The Customer shall provide access to the job site, utilities (such as electrical power if applicable), and all necessary approvals, permits, or permissions required for the completion of the project.

9. Termination

Either party may terminate the agreement by written notice. The Customer is responsible for payment for all labor and materials provided up to the date of termination, including any non-returnable or special-order materials.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Alaska. Any disputes arising under this agreement shall be resolved in a court of competent jurisdiction within the State of Alaska.

11. Acceptance

By signing an estimate, approving an invoice, or allowing work to begin, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.

12. Indemnification

The Customer agrees to indemnify, defend, and hold harmless Alaska Smart Home Designs, LLC, dba: Alaska Home Renovations & Repairs, its owners, employees, subcontractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:

  • the Customer’s actions, omissions, or negligence;

  • unsafe or hazardous conditions on the property not caused by the Company;

  • third-party interference or damages; or

  • the Customer’s failure to comply with applicable laws, permits, or regulations.

This indemnification shall not apply to damages caused by the sole negligence or willful misconduct of the Company.
